Data protection declaration

With this declaration we inform you about data protection-related aspects and about the measures used to protect your rights. NICOCYL GmbH complies with the requirements of the Federal Data Protection Act (BDSG) and the EU General Data Protection Regulation (EU GDPR).

1. Collection and use of personal data

1.1. Basics

Your data is used solely to provide you with the most user-friendly, practical and secure Internet service possible. Personal data includes all information about the personal or factual circumstances of a specific or identifiable natural person, e.g. name, address, contact details, IP addresses, data volumes transferred, etc.

1.3. Automatic processing by website operation

The websites are operated by a provider in Germany, which in turn stores access to the system in so-called server logs for the operation of the website. The following data is usually collected: IP addresses, time stamps of access, names of the websites, transferred data volumes, logouts or terminations, browser types, information from the operating system, referrer URLs. We do not store or evaluate this data. In the event of a justified suspicion of misuse based on specific information, these log files can be checked subsequently.

1.4. Data input by the website user

You can also use our websites without restrictions without entering personal data. If we collect personal data (contact form, booking forms, etc.), we will inform you about the purpose, scope, legality and possible transfers and only use it for these purposes. You enter this data voluntarily.

2. Use of the data

2.1. 2.1. We use the personal data collected and processed exclusively for the purposes of providing our services from the user agreement concluded with you and for processing payments. NICOCYL GmbH naturally observes all applicable data protection laws, in particular the Federal Data Protection Act/EU GDPR and the Telemedia Act (TMG). 

In addition to the legitimate interest under Art. 6 Para. 1 lit. f GDPR for the secure operation of the website and the defense against attacks, Section 25 Para. 2 TDDDG also applies in relation to browser data that is automatically transmitted through its use.

2.2. We do not pass on your personal data to third parties for marketing or similar purposes. Data is only passed on if and to the extent that this is necessary to implement the user agreement, we are legally obliged to do so or it is necessary to enforce the general terms of use or other agreements concluded with you as well as our rights and claims.

2.3. Customer information by email

As part of customer loyalty, we send current information to our customers to inform you about news and changes within our range. This information should not be confused with the general newsletters. If it concerns our offers and contains, for example, security-relevant points or important information from our company, we can only handle this by email. Please understand this.

2.4. Newsletter

If you have decided to receive the newsletter, we will use the email address you registered with to inform you about news. We use the requested salutation and your name to be able to address you personally and to keep the suspicion of SPAM as low as possible. Information is sent to this email address at regular intervals. If you no longer wish to receive information by email, you can revoke your consent to the newsletter at any time. Let us know in writing. You will find this notice below every newsletter email. 

3. Cookies

Our website uses cookies to offer you effective and user-friendly handling. This makes the use of cookies necessary and justifies our legitimate interest in using this technology. Most browsers offer you the functionality to display the cookies used.

If cookies are used that track user behavior, personal data is usually processed that falls under both the GDPR and the TDDDG. Therefore, Section 25 Para. 1 TDDDG also applies here with regard to the GDPR.

If you would like to prevent the use of cookies in general, your browser has the option of preventing the acceptance and storage of new cookies. To find out how this works with your browser, please use the help function of the respective browser. However, we recommend that you leave the cookies functions switched on, as only then will you fully benefit from the high level of user comfort that we have set up for you. We do not create user profiles from the user data collected by cookies.

4. Website evaluations or tools

We use the following analysis tool to evaluate our websites and describe it to you as follows:

Matomo (formerly PIWIK)

This website uses Matomo (formerly PIWIK), which uses cookies for use. This service is hosted on our own web server in Germany. The IP address is automatically shortened and transmitted to the server with the other information for evaluation. The IP shortening anonymizes the data so that no conclusions can be drawn about the user (identification). The data collected by the cookies is not passed on to third parties.

The legal basis for analyzing the usage behavior of our website arises from the legitimate interest in accordance with Art. 6 Paragraph 1 Letter f of GDPR. Browser data or header information that is inevitably collected and transmitted through the browser settings of the end device falls under Section 25 Paragraph 2 TDDDG.

You can prevent the use of cookies through your browser, but this may restrict the operation of the website.

Google Maps

These websites contain plug-ins from Google Maps, a service from Google Inc., San Bruno/California, USA. When you visit content on our websites that includes a map from Google Maps, a connection to Google's servers is established. The Google server is informed which pages of our website you have visited. If you are logged into your Google account at the same time, Google can link your surfing behavior to your personal profile. You can prevent this possibility of assignment by first logging out of your account.

For the map view of Google Maps, we require your consent in accordance with Art. 6 Para. 1 lit. a GDPR in combination with Section 25 Para. 1 TDDDG.

5. Security

We use technical and organizational security measures to ensure that your personal data is protected against loss, incorrect changes or unauthorized access by third parties. In any case, only authorized persons have access to the personal data, and only to the extent that it is necessary for the purposes mentioned above. The security measures are constantly adapted to the improved technical possibilities.

6.2. Storage period

We store your data as long as the purpose of storage remains the same (inquiries, projects, contracts, etc.). If the purpose no longer applies or you withdraw your consent, your data will be deleted through regular deletion unless statutory retention periods must be observed.

6.3. Children

We will not knowingly collect and process data from children. If students make inquiries, we will only store the data if we have the express consent of their legal guardians. If data from children can then be stored, we will only pass it on within the framework of the legal requirements. The term “children” includes the definitions from national law and the legal provisions applicable to us.

6.4. Profiling of your data does not take place

We do not make automated decisions and/or profile your data.

6.5. Your rights

You can contact us at any time if you want to request information, deletion, restriction or objection. Use the contact details provided for this purpose. Requests must be made in writing so that we can clearly identify the requester.

6.6. Right to complain

If you have legitimate doubts about how we handle your data, inform us or contact the relevant supervisory authority.

6.7. Changes

We reserve the right to adapt this data protection declaration from time to time. We therefore recommend that you regularly review this declaration.
